    These Terms of Service govern your use of our AI-verified influencer marketing platform with secure Escrow payments. Our mission is to protect brands and creators while fostering authentic collaborations.

    1. Acceptance of Terms

    By accessing or using CollabSmart ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not use the Platform.

    • You must be at least 18 years old or the age of majority in your jurisdiction
    • Brands must be legally registered commercial entities
    • Creators must have authentic and active social media accounts
    • All users must provide accurate and complete registration information

    2. Escrow & Payments — Stripe Custody

    CollabSmart uses a Secure Escrow Payment system powered by Stripe. Funds are held in custody and released only after AI validation confirms contract fulfillment.

    3. AI Verdict — Binding Decision

    CollabSmart's AI system evaluates contract compliance and its decision is binding for both parties, subject to a human appeal process.

    4. Intellectual Property Rights

    Content rights are carefully managed to protect both creators and brands throughout the collaboration lifecycle.

    5. Collaboration Guidelines

    CollabSmart facilitates professional collaborations with clear responsibilities for both parties.

    • Brands: Provide clear briefs, timely responses, and punctual Escrow deposits
    • Creators: Deliver content per specs, disclose sponsorships per FTC/local regulations
    • All content must comply with applicable advertising laws
    • No misleading content, hate speech, or promotion of illegal activities

    6. Prohibited Activities

    To protect our community, the following activities are strictly prohibited and may result in immediate account termination:

    • Fake followers, artificial engagement, or inflated metrics
    • Attempting to bypass the Escrow system or manipulate transactions
    • Identity impersonation or providing false verification information
    • Money laundering or processing illegal payments through the platform

    7. Limitation of Liability

    CollabSmart is a technology platform, not a financial institution. Payment services are provided by Stripe. • Our total liability is limited to fees paid in the preceding 12 months • We do not guarantee campaign success or specific results • The Escrow system protects transactions but does not guarantee subjective content quality • Third-party services (Stripe, social media APIs) are governed by their own terms

    8. Dispute Resolution

    We encourage resolution through our internal mediation first. • Contact support to initiate dispute resolution • Neutral mediation for campaign and Escrow-related disputes • Most disputes resolved within 14 business days • Unresolved disputes subject to binding arbitration under AAA Commercial Rules • Arbitration location: San Francisco, California

    9. Modifications & Governing Law

    These Terms may be modified at any time. Material changes will be communicated via email or platform notification. These Terms are governed by the laws of the State of California, USA. You agree to submit to the personal jurisdiction of the courts located in San Francisco, California.
